Lawyer Conveyancers or Licensed Conveyancer

Law_350_4There is a considerable amount of confusion and divergence that has been characterising the legal conveyance system in Australia. The distinction of two types licensing for carrying out the legal work adds to this confusion.  This would be clear when one goes through the following paragraphs.

The Conveyance Act, 2006 defines the nature and scope of Conveyancing under the Australian Laws. Under its legal framework, the Law recognises two types of Conveyancers, viz., licensed and lawyer conveyers.

 

(a) Licensed Conveyancers:

A licenced conveyancer is qualified to provide conveyancing services to a consumer. Licensed conveyancers usually offer cheaper rates than lawyer conveyancers. The scope of the work of licensed conveyancer is restricted as he/she cannot provide advice a consumer with a legal advice. A licenced conveyancer performs conveyancing work as long as ithey stay within conveyancing work as defined in the Act.

(b) Lawyer Conveyancers:

The Lawyer Conveyancers provide the most comprehensive form of legal representation arising out of any real estate conveyancing transaction.

Licensed conveyancers are able to undertake a wide range of legal work relating to property and business. They may act as legal advisors in the sale, purchase, mortgage or lease of residential and commercial property and small business, within the guidelines set down in the current Conveyancers Licensing Act.

The common public may not be aware of the above distinctions and the fact that  Conveyancers are not permitted to carry on business in conjunction with others where there may be a conflict of interest, for example real estate agents.

It is hoped that this article provides useful information to at least to minimise the incidence of this.
